1. Introduction
Welcome to Payrovia Flex. These Terms of Service ("Terms") govern your use of the Payrovia Flex platform, including our website, mobile application, and WhatsApp integration (collectively, the "Service"), operated by Jobsite Jack Ltd ("we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Description of Service
Payrovia Flex is a workforce marketplace that connects construction businesses ("Businesses") with skilled tradespeople ("Workers"). Our platform enables:
- Job posting and worker discovery
- GPS-verified time tracking
- Escrow-protected payments
- Digital timesheet management
- WhatsApp-based interactions
Payrovia Flex is a technology platform and does not employ Workers. We facilitate connections between Businesses and Workers but are not party to any employment or contractor relationship between them.
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and have the legal right to work in the United Kingdom to use our Service as a Worker. Businesses must be legally registered entities.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
3.3 Verification
We may require identity verification and right-to-work checks. You agree to provide accurate information and to keep it updated. Providing false information may result in account termination.
4. Terms for Workers
4.1 Profile Accuracy
You must accurately represent your skills, certifications, and experience. Misrepresentation may result in account termination and liability for damages.
4.2 Time Tracking
You must use our GPS-verified clock-in/out system honestly. Falsifying location data or time records is grounds for immediate account termination and may be reported to relevant authorities.
4.3 Job Commitments
Once you accept a job, you are expected to attend as agreed. Repeated no-shows or late cancellations will negatively impact your rating and may result in account restrictions.
4.4 Conduct
You must conduct yourself professionally on job sites and comply with all applicable health and safety regulations.
5. Terms for Businesses
5.1 Job Listings
Job listings must be accurate and include all relevant information about the role, location, duration, and pay rate. You must comply with all applicable employment and discrimination laws.
5.2 Worker Status
You are responsible for determining the correct employment status of Workers you engage through our platform and for meeting all applicable tax, insurance, and employment obligations.
5.3 Workplace Safety
You must provide a safe working environment and comply with all health and safety regulations. You are responsible for any necessary personal protective equipment (PPE) and site inductions.
6. Payments and Escrow
6.1 Escrow System
Businesses deposit funds into escrow when confirming a Worker. Funds are held securely until the timesheet is approved and both parties confirm job completion.
6.2 Payment Release
Payments are released to Workers after Business approval of timesheets. We aim to process payments within 3-5 business days of approval.
6.3 Fees
Payrovia Flex is free for Workers. Businesses pay a platform fee as detailed in our pricing page. All fees are subject to VAT where applicable.
6.4 Refunds
Escrowed funds may be refunded to Businesses in cases of verified no-shows or where our dispute resolution process determines a refund is appropriate.
7. Dispute Resolution
In case of disputes between Workers and Businesses regarding time worked, quality of work, or payments:
- Either party may raise a dispute through the platform
- We will review GPS data, timesheets, messages, and any other relevant evidence
- We will make a fair determination based on the evidence available
- Our decision is final with respect to release of escrowed funds
This dispute resolution process does not prevent either party from seeking legal remedies in court.
8. Prohibited Activities
You must not:
- Use the Service for any illegal purpose
- Harass, abuse, or discriminate against other users
- Submit false or misleading information
- Attempt to bypass our payment system
- Manipulate ratings or reviews
- Scrape or collect data from our platform
- Interfere with the proper functioning of the Service
- Create multiple accounts to circumvent restrictions
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Payrovia Flex Ltd and are protected by copyright, trademark, and other intellectual property laws.
10. Limitation of Liability
To the fullest extent permitted by law, Payrovia Flex Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use or inability to use the Service
- Any conduct or content of other users
- Quality of work performed by Workers
- Accuracy of information provided by Businesses
- Any unauthorised access to your account
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Payrovia Flex Ltd from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or our business interests.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
